Accidents at Work (Employers’ Liability)
Employers have a legal responsibility to do all they reasonably can to keep their employees contractors and visitors safe whilst at work or visiting work premises. If you are injured at work, and you think your employer is at fault, then you can make a claim for compensation.
Your employer must provide you with the correct machinery and tools to enable you to do your job; they need to ensure that the machines and tools are maintained in a safe condition and that any person using the machinery is trained properly in how to use it. You may have been injured because you had not been given adequate safety training or the correct equipment to use, or someone working with you may have acted dangerously and caused your injury.
The workplace must kept in a safe and tidy condition, floors and corridors should be clean and free from hazards. All employees who are required to lift heavy objects should receive training to show them how to do this safely to avoid back strain caused by lifting heavy packages.
Safety wear must be provided when required - for example goggles, hard hats, ear defenders, dust masks, safety gloves, safety boots or high-visibility jackets. Broken wrists/ankles from falls, cut/lost fingers because of inadequately guarded saws, broken toes from heavy objects being dropped are all common injuries at work.
There is a higher responsibility on employers for people who work on construction sites and for those who work at height.
If you have been involved in an accident at work in the last three years and have suffered a personal injury then you may be entitled to claim compensation. Your claim is not limited to compensation for the injury - you are also able to recover loss of earnings (including loss of overtime and bonuses), medical expenses and, if you are unable to return to work, future loss of earnings, as well as any other items you have incurred because of the accident.
Your employer cannot dismiss you or discipline you for making a claim for compensation; employers have to have insurance to cover them for accidents at work.
So, if you think you have a claim, simply complete the short questionnaire below and we'll check it for you. It won't cost you anything, there is no obligation for you to pursue a claim, and you'll get a prompt response from our specialist claims team.
