Hit and Run Accidents
If you have been involved in an accident through no fault of your own and the person responsible has left the scene of the accident then you can still claim compensation for your injuries and associated losses.
The Government set up The Motor Insurers' Bureau (MIB) who have a fund that will pay compensation if it cannot be claimed from another source i.e the responsible party. It is important to ensure that the police have been informed of the accident as this is part of the requirements they must be informed within 14 days of the accident occurring if you are injured or within 5 days if your claim is for damaged property alone.
The police will tell you if their enquiries have failed to identify an offending motorist, but it is helpful if you contact a solicitor straight away as there are time limits for claims to be made.
As with all claims for personal injury the claim must be made within three years from the date of the accident. If your claim is for damaged property the time period is much shorter and the claim must be made within 9 months; a £300 excess will apply for damaged property claims.
The MIB will need information about the accident, details of your injuries and your losses and you will be asked to provide authority to obtain evidence from, amongst others, your doctor and your employers.
The MIB will then investigate the claim; this involves contacting the police to obtain a copy of the report that they will have compiled. The MIB will need to establish liability and may appoint a claims investigator to assist in taking statements and will gather other claims related information.
If the MIB are satisfied that the accident wasn’t your fault they will put forward an offer to settle your claim.
